Louise Selby Terms and Conditions
By paying the deposit for Goods and Services ("the Contract") you, the customer, are entering into a binding agreement to purchase, and for Louise Selby to supply, the wedding dress ("the Dress") and any accessories ("the Accessories") the details of which are given in the invoice order summary.
Both you and Louise Selby agree to be bound by the following terms and conditions:
The Dress
1. The Dress is made to your order on the basis of the measurements which will be or have been taken at, or at about, the time that this contract is made (the "Measuring Appointment"). You acknowledge that the measurements are correct and that you do not expect them to change significantly between the Measuring Appointment and the completion of the Dress.
2. After the Measuring Appointment, a calico toile of the Dress is made and this will be tried on at a fitting appointment ("the CalicoAppointment"). Any significant weight changes causing alterations to be made to the Dress after the Calico Appointment will be subject to additional charges at an hourly rate of £100, for which you will be responsible.
3. Any changes made to the design of the Dress after the Calico Appointment will be charged at an hourly rate of £100, for which you willbe responsible.
Payment Terms
4. The total due under the Contract (the “Order Total”) is shown in the invoice order summary.
5. You agree to pay a non-refundable deposit of 50% of the Order Total on the date that the order is placed.
6. The balance outstanding under the Contract for the Dress and the Accessories falls due for payment 14 days after the date on which you are notified by Louise Selby by text message, data message, first class post, email or telephone, that the dress has been completed ("the Completion Notice"). Payment is to be made by bank transfer, debit card or cash.
7. Interest will accrue on any unpaid amounts at 1% above Barclays Bank PLC base rate from time to time.
8. The Dress, Accessories and fabric remain the property of Louise Selby until the Order Total is paid in full.
9. A storage charge of £10 per day will be charged 14 days from the date of the Completion Notice in the event that the dress has not been collected.
Cancellation or postponement
10. Should the wedding be cancelled or postponed for any reason whatsoever, then the outstanding balance under the Contract becomes due (a) in the case of a cancellation, at the date of the cancellation or receipt of the Completion Notice (whichever is the earlier) and, (b) in the case of postponement, on the date originally fixed for the wedding (the “Supply Date”) as stated on the invoice or receipt of the Completion Notice (whichever is the earlier).
Collection of the Dress
11. It is your responsibility to collect the Dress and the Accessories from Louise Selby. In the event that delivery is required Louise Selby can arrange this, but you will have to pay the courier fee will and delivery will be at your own risk.
12. Once you have collected the Dress, any alterations that you subsequently require to be made will be chargeable at an hourly rate of £100.
Sample Sales
13. All sample wedding dress sales are sold as seen with no refund, return or exchange. Payment is required in full. Any alterations required, will be chargeable at an hourly rate of £50.
Insurance
14. Louise Selby recommends that you take out insurance to cover the cost of the Dress in the event of cancellation, postponement or any other significant changes. This is a matter for you.
Damage
15. Any damage incurred to the Dress during fittings caused by you is your responsibility and you must pay for whatever further costs are incurred in order to rectify the damage.
Photography
16. No photography is allowed in Louise Selby’s studio.
Disputes
17. The Contract is governed by English law and is subject to the exclusive jurisdiction of the English courts. Any disputes relating to the Contract will be determined in the Wandsworth County Court.
